Platform Terms of Use

Effective date: 14 April 2026

Welcome to Talent Unlimited, a trading name of Talent Tech Limited (“we”, “us”, or “our”). These Platform Terms of Use (“Terms”) govern your access to and use of our platform, including any associated applications, services, and features (the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

These Terms apply to users of the Platform in a business or organisational capacity. Candidates using the Platform are subject to separate Candidate Terms where applicable.

Please also review our Privacy Policy and any applicable Data Processing Agreement (DPA).

1. Acceptance of Terms

By using the Platform, you confirm that you are legally capable of entering into these Terms. If you are using the Platform on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.

2. Access to the Platform

We grant you a limited, non-exclusive, non-transferable right to access and use the Platform for your internal business purposes.

We may update, modify, remove, suspend, or discontinue any part of the Platform at any time.

We may update these Terms from time to time to reflect changes in our services or legal requirements. Any updates will be effective when posted on this page. For material changes, we will take reasonable steps to notify you in advance where appropriate.

3. Accounts

To access certain features, you may be required to create an account.

You agree to:

  • provide accurate and complete information;
  • keep your login credentials secure;
  • notify us of any unauthorised access.

You are responsible for all activity under your account.

We may suspend or terminate your account if you breach these Terms.

4. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms.

You must not:

  • use the Platform in any unlawful or unauthorised manner;
  • attempt to gain unauthorised access to the Platform or related systems;
  • interfere with or disrupt the Platform;
  • upload or submit content that is unlawful, misleading, or infringes third-party rights;
  • discriminate unlawfully against candidates;
  • process or store personal data for purposes unrelated to recruitment;
  • submit data that you do not have the right to use.

You are responsible for ensuring that information you provide to the Platform is accurate and up to date.

5. AI-Powered Features

The Platform includes AI-powered features designed to support recruitment processes, including candidate screening, interview analysis, and insights.

These features:

  • provide analysis and recommendations only;
  • are intended to support, not replace, human decision-making.

You should not rely solely on outputs generated by the Platform when making hiring decisions.

You are responsible for reviewing and validating outputs generated by the Platform and for ensuring that decisions are made with appropriate human oversight.

Candidates may have the right to request human review of automated assessments, as described in our Privacy Policy or applicable Candidate Terms.

We do not guarantee any hiring outcomes or results from use of the Platform.

You are responsible for ensuring that your use of the Platform, including any AI-powered features, complies with applicable laws and regulations in your jurisdiction, including those relating to recruitment, employment, and automated decision-making.

6. User Content

You may upload or provide content to the Platform, including candidate data, job descriptions, and other materials (“User Content”).

You grant Talent Unlimited a non-exclusive, worldwide, royalty-free licence to use, process, store, and analyse User Content for the purpose of providing and improving the Platform.

You confirm that you have all necessary rights to provide such User Content and that it does not infringe any third-party rights.

7. Candidate Data and Data Roles

Depending on the context, Talent Unlimited may act as both:

  • a Data Processor (when processing data on your behalf); and
  • a Data Controller (when independently determining how data is used, including for platform functionality and candidate matching).

You agree that:

  • you are responsible for ensuring that candidate data is collected, used, and shared with Talent Unlimited lawfully, including having a valid legal basis under applicable data protection laws and all necessary rights, consents, and permissions to provide such data and permit its processing by Talent Unlimited, including where that data is exchanged via integrations as described in clause 12;
  • you have provided appropriate notices to candidates regarding the use of the Platform.

Where applicable, a separate Data Processing Agreement (DPA) governs processing carried out on your behalf.

We may engage subprocessors in connection with the provision of the Platform as described in the DPA.

Further information on how personal data is stored, retained, and deleted is set out in our Privacy Policy and, where applicable, the DPA.

8. Candidate Engagement and TalentBank

The Platform may identify candidates suitable for roles based on available data.

The Customer acknowledges that Talent Unlimited may contact candidates directly, including about other relevant opportunities.

Candidates are informed of this use through Talent Unlimited’s Privacy Policy, Candidate Terms (where applicable), and interactions with the Platform (including application and interview processes), and are provided with the ability to opt out at any time.

9. Intellectual Property

All intellectual property rights in the Platform, including software, content, and features, are owned by or licensed to us.

You are granted a limited right to use the Platform in accordance with these Terms. You must not:

  • copy, modify, reverse engineer, or attempt to extract source code from the Platform;
  • use the Platform to build a competing product or service.

10. Confidentiality

We will treat any non-public information you provide through the Platform as confidential and will not disclose it to third parties except as necessary to provide the Platform or as required by law.

This does not apply to information that:

  • is publicly available;
  • was already known to us without restriction; or
  • is independently developed without use of your information.

11. Third-Party Services

The Platform may integrate with or rely on third-party services.

We are not responsible for the content or performance of third-party services. Your use of such services is at your own risk.

12. Integrations and API Access

The Platform may allow you to connect with third-party systems (including applicant tracking systems and other services) and to access or exchange data via APIs.

You acknowledge that:

  • integrations may involve the transfer of personal data and other information between the Platform and third-party systems;
  • you are responsible for ensuring that any data shared with or received from third-party systems is lawful, accurate, and appropriately authorised;
  • your use of third-party systems is subject to their own terms and privacy policies.

Where you use API access:

  • you are responsible for maintaining the security and confidentiality of API keys and credentials;
  • you must not share API credentials with unauthorised parties;
  • you are responsible for all activity carried out using your API credentials.

We may impose reasonable limits or controls on API usage to protect the integrity and security of the Platform. Exceeding such limits may result in temporary restriction or suspension of API access.

We are not responsible for:

  • the availability, security, or performance of third-party systems;
  • any loss, misuse, or unauthorised access resulting from your failure to secure API credentials or third-party integrations.

13. Availability and Warranties

We do not guarantee that the Platform will be uninterrupted, secure, or error-free.

The Platform is provided on an “as is” and “as available” basis.

We may suspend or restrict access where necessary for maintenance, security, or operational reasons.

14. Beta Features

We may make certain features available on a beta or preview basis. These features may be subject to change, interruption, or removal at any time and are provided without any additional warranties.

15. Limitation of Liability

To the extent permitted by law, we exclude all liability for any indirect or consequential loss arising from your use of the Platform.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

16. Termination

We may suspend or terminate your access to the Platform at any time if you breach these Terms.

You may stop using the Platform at any time. Where applicable, termination of paid services will be governed by your Commercial Terms.

Following termination, access to the Platform will cease. Personal data will be handled in accordance with the Privacy Policy and, where applicable, the DPA.

17. Force Majeure

We will not be liable for any failure or delay in performance of the Platform arising from events beyond our reasonable control, including but not limited to infrastructure failures, third-party service outages, or regulatory actions.

18. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force.

Our failure to enforce any provision does not constitute a waiver of our rights.

These Terms apply to your use of the Platform unless superseded by a separate written agreement between you and Talent Tech Limited (including any Commercial Terms).

In the event of any conflict:

  • the Commercial Terms will take precedence;
  • these Terms will take precedence over the Privacy Policy; and
  • the Privacy Policy and DPA will govern matters relating to personal data.

19. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a business, the courts of England and Wales have exclusive jurisdiction.
